  1. About the Platform & Roles
    1. The Platform is a technology infrastructure provided by IVO Limited that connects individual and corporate donors with the Organization.
    2. For the purpose of these Terms, “Donation” shall comprehensively include general donations, fundraising contributions, and religious offerings (including tithes, thanksgiving offerings, and other church offerings).
    3. You acknowledge and agree that IVO Limited acts strictly as a neutral technology intermediary. IVO Limited is not a party to the donation transaction, does not control how the Organization uses the donated funds, and shall not be held liable for any dispute between you and the Organization.
  2. Platform Usage & User Accounts
    1. Eligibility: You must be at least 18 years old (or the age of legal majority in your jurisdiction) to make a Donation or create an account on the Platform.
    2. Account Security: If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must inform us immediately of any suspected security breach.
    3. Prohibited Conduct: Users agree not to:
      • Use the Platform for any fraudulent, unlawful, or unauthorized purpose, including money laundering or terrorist financing.
      • Interfere with or disrupt the security or integrity of the Platform.
      • Attempt to gain unauthorized access to any system, data, or user account.
  3. Donations & Payment Processing
    1. Authorization & Payment Process:
      • When you make a Donation through the Platform, you authorize our designated third-party payment processor(s) to charge your selected payment method for the specified amount.
      • All donations are processed securely via third-party payment gateways. Accepted payment methods include credit cards, PayPal, FPS (Faster Payment System), AlipayHK, and PayMe.
      • Donations are processed in Hong Kong Dollars (HKD) unless otherwise specified.
    2. Recurring Donations:
      • If you opt for a recurring (monthly/annual) Donation, you authorize the Platform and its payment processors to automatically charge your designated payment method on a recurring basis until you cancel.
      • You may modify or cancel your recurring Donation at any time by logging into your account settings at least 5 business days prior to the next billing cycle.
    3. Platform & Processing Fees:
      • Transaction fees apply to Donations processed through the Platform. These fees are payable by the Organization. Where applicable, Donors may be given the voluntary option to cover these transaction fees as part of their Donation at checkout.
    4. Currency & International Transactions:
      • If you donate using a foreign payment method, your card issuer or bank may apply currency conversion rates and foreign transaction fees for which neither the Organization nor IVO Limited is responsible.
  4. Refund & Cancellation Policy
    • Finality of Donations: Due to the nature of charitable giving and religious offerings, all Donations made through the Platform are considered final and non-refundable.
    • Refund Requests: As the technology provider, IVO Limited does not hold donated funds and cannot process refunds. Any request for a refund under exceptional circumstances (such as unauthorized fraudulent transactions or technical duplicate charges) must be made directly to the Organization at [Insert Support Email] within 30 days of the transaction date.
    • Discretion: The decision to grant and process a refund rests solely with the Organization in accordance with its internal policies and applicable laws. IVO Limited will not mediate or become involved in any refund disputes.
  5. Tax Receipts & Deductibility
    • Tax deductibility of Donations depends on the tax-exempt status of the Organization and the tax laws applicable in your jurisdiction.
    • Neither the Organization nor IVO Limited provides tax advice. Tax receipts, if applicable, may be issued either directly by the Organization or automatically by the Platform on behalf of the Organization. Donors are solely responsible for determining the tax consequences of their Donations.
  6. Use of Funds & Organization Responsibility
    • The Organization is solely responsible for accurately representing its cause, mission, and how donated funds will be utilized.
    • Donors acknowledge that IVO Limited does not guarantee or warrant that Donations will be used for specific intended purposes by the Organization once remitted. Donors are responsible for conducting their own due diligence on the Organization before making a Donation.
  7. Intellectual Property
    1. All content, branding, code, software, logos, and graphics of Unify Donation on the Platform are the intellectual property of IVO Limited or its licensors and are protected by applicable laws. You agree not to reproduce or redistribute such property in any way.
    2. Logos, branding, and organization names displayed on the Platform belonging to the Organization remain the property of the Organization.
  8. Limitation of Liability & Disclaimer
    1. “As-Is” Service: The Platform is provided on an “as is” and “as available” basis. Neither the Organization nor IVO Limited warrants that the Platform will be uninterrupted, error-free, or free from service disruptions.
    2. Limitation of Liability: To the maximum extent permitted by applicable law, IVO Limited, its affiliates, and their respective directors, employees, volunteers, and agents shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your use of the Platform or payment services.
    3. No Liability for Funds: IVO Limited shall have no liability whatsoever regarding the Organization’s use, misuse, or failure to use the donated funds, or the failure of the Organization to achieve its stated goals.
    4. Maximum Aggregate Liability: In no event shall the Organization’s or IVO Limited’s aggregate liability exceed the total platform fees retained for the transaction in question, or $100 USD , whichever is lower.
  9. Privacy & Personal Data
    1. Account Security: You are responsible for ensuring the accuracy of your registered personal information and maintaining the safety and security of your account. We and the Platform Provider reserve the right to terminate accounts, edit or remove content, and cancel transactions at our sole discretion.
    2. Data Sharing: By making a Donation, you consent to the Platform sharing your contact details (such as name, email, and contact information) and donation records with the Organization for administration, record-keeping, tax receipt issuance, and updates, unless you select the option to donate anonymously.
    3. Privacy Policy: All data collection and processing are governed by the Privacy Policy of the Platform, which forms part of these Terms.
  10. Uploaded Content

    If you choose to submit or upload any content (e.g., photos, videos, or screenshots) to the Platform, you warrant that such content:

    • Is not unlawful, threatening, abusive, defamatory, obscene, vulgar, offensive, or indecent;
    • Does not violate or infringe the intellectual property, privacy, or proprietary rights of third parties;
    • Does not contain computer viruses or harmful components;
    • Does not contain unauthorized advertising or commercial solicitations.

    We and the Platform Provider reserve the right to remove any content that does not comply with these standards, and to disclose your identity to any third party claiming that your content violates their intellectual property or privacy rights.

  11. Modifications to Terms

    The Organization and IVO Limited reserve the right to edit, modify, and change these Terms at any time. We will notify users of changes by posting the updated terms on the Website. Your continued use of the Platform after changes indicates your binding acceptance of the new terms.

  12. Governing Law & Dispute Resolution

    By using the Platform, you agree that the laws of the Hong Kong Special Administrative Region (“HKSAR”), without regard to principles of conflict of laws, will govern these Terms and any dispute of any sort that might arise between you, the Organization, and IVO Limited. Any dispute shall be submitted to the exclusive jurisdiction of the courts of the HKSAR.
